Senate Bill 2: The Mid-Michigan Infrastructure Freedom Act

A BILL
To rehabilitate and replace critical infrastructure in Michigan’s 35th Senate District, terminate private tolling leases on Bay City’s Liberty and Independence Bridges, cap tolls at $1, and secure state funding for safe, accessible transportation without increasing taxpayer burden—fostering economic growth and community resilience.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Section 1. Short Title
This act may be cited as the “Mid-Michigan Infrastructure Freedom Act.”
Section 2. Purpose
To address the infrastructure crisis in the 35th Senate District by:
(a) Terminating the Bay City Bridge Partners (BCBP) lease agreement and capping tolls at $1 per crossing.
(b) Allocating $100 million over five years to rehabilitate roads, sidewalks, and bridges, prioritizing Bay City’s bascule bridges.
(c) Ensuring no new tax increases by leveraging state surpluses and federal grants.
Section 3. Definitions
(a) “35th District” refers to Bay, Midland, and Saginaw counties.
(b) “BCBP” means Bay City Bridge Partners, the private entity leasing Liberty and Independence Bridges.
(c) “Overhaul Fund” means the Mid-Michigan Infrastructure Overhaul Fund established herein.
Section 4. Termination of BCBP Lease
(a) The Michigan Department of Transportation (MDOT) shall negotiate the termination of the BCBP lease, effective no later than December 31, 2026.
(b) MDOT shall compensate BCBP for verified investments (estimated $30 million) using the Overhaul Fund, not exceeding $35 million.
(c) Upon termination, tolls on Liberty and Independence Bridges shall not exceed $1 per crossing, adjustable for inflation every 5 years.
Section 5. Infrastructure Overhaul Fund
(a) Establishes the “Mid-Michigan Infrastructure Overhaul Fund” with:
- $50 million from state budget surplus (FY 2026).
- $50 million from federal Bipartisan Infrastructure Law (BIL) grants, leveraging Michigan’s $13 billion allocation.
(b) Funds shall be allocated over 5 years (2026-2030) for:
- $40 million: Rehabilitation or replacement of Liberty and Independence Bridges.
- $30 million: Road repairs (e.g., M-25 potholes, Saginaw streets).
- $20 million: Sidewalk and flood mitigation (e.g., Midland’s Tittabawassee River zone).
- $10 million: Local job creation (e.g., hiring 35th District workers).
(c) MDOT shall prioritize projects based on public input and condition assessments.
Section 6. Toll Cap Enforcement
(a) Effective January 1, 2026, tolls on Liberty and Independence Bridges shall not exceed $1 per crossing.
(b) MDOT shall assume ownership and maintenance post-BCBP termination, funded via the Overhaul Fund.
Section 7. Public Oversight
(a) Creates a “35th District Infrastructure Council” (5 members: 2 elected residents, 1 Bay City official, 1 Midland official, 1 Saginaw official) to oversee fund use and report annually to the Senate.
(b) Council meetings shall be public, with online access.
Section 8. Funding Assurance
(a) No new taxes or fees shall be levied to support this act.
(b) MDOT shall pursue additional federal grants (e.g., BIL’s $12.5 billion Bridge Investment Program) to supplement the Overhaul Fund.
Section 9. Effective Date
This act takes effect upon passage and signature by the Governor, with implementation beginning January 1, 2026.
